Ohio Considers Petition Asking That Cleveland Browns or Cincinnati Bengals Fandom Be Considered a Qualifying Condition for Ohio Medical Marijuana Card

A new qualifying condition is being considered for Ohio residents seeking medical marijuana recommendations. It is one of 28 new conditions petitioned in 2019 for acceptance into the Ohio Medical Marijuana Control Program. Cleveland Browns and Cincinnati Bengals fans might be interested to know that, besides the conditions already listed, just being a fan could mean pre-qualification for a medical marijuana recommendation! Medical marijuana became legalized in Ohio in the fall of 2016 when the Ohio Medical Marijuana Control Program was signed into law via the Ohio House Bill 523. At that time, 21 qualifying medical conditions were listed as approved for treatment with medical marijuana. Many common conditions were not listed such as depression, anxiety, and insomnia. To accommodate the requests of many patients, the law fortunately allows for new conditions to be added to the list via a petition process period which takes place between November 1st and December 31st each year.2 One such request, submitted in 2019, petitions that “Cleveland Browns or Cincinnati Bengals fandom be considered a qualifying condition to legally obtain medical marijuana.”1 Believe it or not, the Ohio Medical Marijuana Control Program is seriously considering the request! 

Of the many submissions, some medical conditions were certainly less comical-sounding, such as PTSD, depression, and Epstein-Barr. Though it may seem to be a joke, chief communications officer at the State Medical Board of Ohio, Tessie Pollock confirmed that Bengals and Browns fandom is actually being thought-about as a qualifying condition. She explained the person who submitted the condition did a lot of work to get it this far. According to state law, she said, the petition included the following required information:1

  • “Information from experts who specialize in the study of the disease or condition;
  • Relevant medical or scientific evidence;
  • Consideration of whether conventional medical therapies are insufficient to treat or alleviate the disease or condition;
  • Evidence supporting the use of medical marijuana to treat or alleviate the disease or condition;
  • Other types of medical or scientific documentation; and
  • Letters of support provided by physicians”

Officially titled “Bengals/Browns Followers,” the petition submission was well thought-out, having included at least a letter of help from knowledgeable medical professionals. It will be looked over by the Medical Board’s Medical Marijuana Committee who will weigh in on February 12th, 2020 with a final vote happening sometime in the summer.

But why do fans of these teams want a medical marijuana recommendation? It seems they haven’t seen many wins lately. Both teams missed the 2019 playoffs with the Bengals’ final record at 2-14 and the Browns at 6-10. In addition, the Browns have yet to play in a Super Bowl and haven’t reached the playoffs since 2002. The Bengals have made it to the playoffs five times, but their last playoff win was in 1990. In the 1980’s, the Bengals made it to the Super Bowl twice but lost to the San Francisco 49ers in both games. Adding to the anxiety felt by fans, “The Browns are now looking for a new head coach while the Bengals are getting ready for the NFL Draft as they have the No. 1 overall pick.”4 Whether Bengals and Browns fan get the extra help they need to make it through the football season remains to be seen.
