The United States Patent and Trademark Office created a policy in 2011 that restricted the ability of cannabis cultivators to register and copyright any strain name. Any product, good, or service that violates the federal Controlled Substances Act is ineligible for trademark protection.
The Gorilla Glue strain became very popular in 2015, and it won many awards, including the High Times Cannabis Cup. The cultivator, Don Peabody, created an LLC called GG Strains. But he was unable to get a federal trademark because his cannabis strain did not meet the USPTO’s lawful use requirements.
The Gorilla Glue Co., which manufactures a well-known brand of adhesive glues, sued GG Strains for both infringing on their name and diluting the original Gorilla Glue trademark. Gorilla Glue is a household name. Not the strain but the adhesive.
The two companies settled out of court with no fines or penalties. However, GG Strains LLC (based out of Las Vegas, Nevada) was forced to change the name of their original strain and subsequent hybrid strains they developed. And they had to hand over their gorillaglue4.com website to the Gorilla Glue Co.
In an interview with Ganjapreneur, Ross Johnson, the founder of GG Strains, stated that the rebranding activities required to settle the case cost the company over $250,000. The parent strains had to be legally renamed as GG1, GG4, and GG5, with no use of the term “Gorilla Glue” on packing or through print and online marketing.
How Was GG4 Developed?
When it comes to marijuana strain origin stories, GG4 has a great one. Around 2011, a legendary cultivator named Joesy Whales had a small accident in a grow room. He accidentally pollinated a Chem Sis (Northern Lights and Chemdawg) female plant with a Sour Dubb. The Sour Dubb strain is a phenotype of Sour Diesel.
The plants that were cultivated from those seeds emerged with four distinct phenotypes by crossing chem’s sister. The fourth one was found to be extra special and interesting, with ‘highly’ attractive characteristics. That phenotype became known as Gorilla Glue #4 or GG4.
Why did they call it Gorilla Glue? Well, the accepted story is the resin from the first batch of Original Glue was so sticky it caused the receiver of a telephone to stick to Joesy’s hand. And much like the adhesive commercials for Gorilla Glue (that showed the same effect with household glue), the name stuck. This part of the origin story didn’t help the trademark infringement case much.
